1. Acceptance of Terms
Welcome to NEEbytes Inc. ("NEEbytes," "we," "us," or "our"). By accessing or using our app-based ecosystem services ("Services"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please refrain from accessing or using our Services. These Terms may be updated from time to time, and the latest version will be posted on our app or website.
2. Description of Services
NEEbytes offers a blockchain-based ecosystem that allows individuals to convert data into our native digital asset NEE coins. Our Services enable users to participate in a data economy where individuals can generate data and receive NEE coins. Companies can access this data by purchasing NEE coins from individuals in open exchanges.
3. User Eligibility
Our Services are available to individuals aged 17 years and above. By accessing or using our Services, you represent and warrant that you are at least 17 years old. Users are solely responsible for complying with their local regulations regarding age restrictions.
4. User Accounts
4.1. Account Creation: To use our Services, users are required to create an account. Users must provide accurate and complete information during the registration process. By creating an account, users consent to receive communications from NEEbytes regarding their account and the Services.
4.2. Account Security: Users are responsible for maintaining the confidentiality of their account credentials, including their username and password. Users are also responsible for all activities that occur under their account. If users suspect any unauthorized access to their account, they must notify NEEbytes immediately.
5. Data Usage and Privacy
5.1. Data Collection: NEEbytes values users' data privacy and only collects the information necessary to provide the Services. We collect two types of data:
a. Analytical Data: We may collect anonymous analytical data, such as website usage patterns, app interactions, and user preferences, to improve our Services and user experience. Analytical data does not contain personally identifiable information (PII).
b. User-Provided Data: Users voluntarily provide data to generate NEE coins within the ecosystem. This user-provided data includes responses to data cards, which are a sequence of questions like surveys. User-generated data is under the user's control and will not be shared without their explicit consent.
5.2. Face Data: NEEbytes uses face recognition technology provided by AWS Rekognition for account authentication. The face data collected is solely used for user verification during the account creation process and to prevent the creation of multiple accounts or robot access. Face data is sensitive user information, and we handle it properly to protect user security and privacy.
5.3. Data Storage and Security: We store user-generated data using AWS S3 technology with end-to-end encryption to ensure data security and confidentiality. NEEbytes follows industry best practices to protect user data from unauthorized access, use, or disclosure.
5.4. Data Sharing: NEEbytes may share anonymous analytical data with third-party services, such as Google and Facebook, for analytics purposes only. User-provided data, including face data, is not shared without explicit user consent, except as required by law or regulation.
5.5. Data Retention: Face data is retained only for the time required for user verification during the account creation process. Once verified, face data is deleted. User-generated data is retained as long as the user's account is active or as required by applicable laws.
5.6. Privacy Policy: For more details on data usage and privacy, please refer to our Privacy Policy, specifically in the section titled "Data Usage and Privacy" and the subsection related to "Face Data."
6. Currency and Commissions
6.1. NEE Coins: NEE coins are the native digital asset of the NEEbytes ecosystem. Users can generate NEE coins by completing data cards manually. The value of NEE coins within the ecosystem is not linked to any external market until the data market becomes fully functional.
6.2. Commissions: When the ecosystem's data market is fully functional, NEEbytes may charge a commission on coins used to purchase data. This commission will not directly affect users; it is designed to support the ecosystem's maintenance and development.
7. User Responsibilities
7.1. Prohibited Activities: Users must not engage in any activities that violate these Terms or applicable laws, including but not limited to:
a. Impersonating others or creating multiple accounts.
b. Using the Services for money laundering, fraud, or illegal activities.
c. Sharing false or misleading information that undermines the credibility of the ecosystem.
7.2. Content Responsibility: Users are solely responsible for the content they provide through the Services. Users must ensure that the content they submit is accurate, complete, and does not violate any third-party rights or applicable laws.
8. Disclaimer of Liability
8.1. Bootstrapped Project: NEEbytes is a bootstrapped crypto project that has not raised any ICO or asked for funds. We believe in the value of data for individuals in an open market and have undertaken this initiative to empower users to monetize their data freely. The idea behind NEEbytes arose during the COVID pandemic when the widespread use of the internet highlighted the need to address data rights and create a platform for a data economy. Our founder was inspired to pursue this project and has been dedicated to its development ever since.
8.2. Limitation of Liability: NEEbytes operates the Services with utmost care and dedication. However, you acknowledge that the Services are provided on an "as-is" and "as available" basis. We expressly disclaim all warranties of any kind, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

8.4. Indemnification: You agree to indemnify and hold NEEbytes Inc. and its affiliates, directors, officers, employees, agents, suppliers, and licensors harmless from and against any liabilities, losses, damages, or costs, including reasonable attorneys' fees, incurred in connection with or arising from any third-party allegations, claims, actions, disputes, or demands asserted against any of them as a result of or relating to your use of the Services, including the collection and usage of face data.
8.5. Termination: Users have the right to terminate their accounts and access to the Services at any time. Termination does not release users from any obligations accrued before termination. NEEbytes reserves the right to terminate or suspend user accounts if violations of these Terms occur or if the user's actions compromise the integrity or security of the ecosystem.
8.6. Governing Law and Jurisdiction: This Agreement shall be governed by and construed in accordance with the substantive and procedural laws of Ontario, Canada, without regard to its rules on conflicts or choice of law. The exclusive jurisdiction and venue for actions related to the subject matter hereof shall be the courts located in Ontario, Canada.
8.7. Changes and Amendments: We reserve the right to modify this Agreement or its terms relating to the Services at any time, effective upon posting of an updated version of this Agreement on the Services. When we do, we will revise the updated date at the bottom of this page. Continued use of the Services after any such changes shall constitute your consent to such changes.
8.8. Acceptance of these Terms: By accessing and using the Services, you acknowledge that you have read this Agreement and agree to all its terms and conditions. If you do not agree to abide by the terms of this Agreement, you are not authorized to access or use the Services.
